Welcome to Hatch Clayworks, LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website [insert website URL], our physical studio, and any services, products, or classes we offer (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Studio Policies outlined below. If you do not agree with these Terms, please do not use our Services.

1. Acceptance of Terms

  • By using our Services, you confirm that you are at least 18 years old or have the consent of a parent or guardian. You agree to provide accurate and complete information when registering, purchasing, or interacting with us.

2. Services Provided

Hatch Clayworks, LLC offers:

  • Ceramic products for purchase.

  • Pottery classes, workshops, and private lessons.

  • Studio access for members or renters (subject to availability).

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.

3. Studio Policies

Our studio policies ensure a safe, respectful, and productive environment for all users. By participating in classes, workshops, or studio activities, you agree to the following:

a. Safety and Conduct

  • Follow all safety instructions provided by instructors or staff, including proper use of tools, equipment, and kilns.

  • Wear appropriate attire (closed-toe shoes, no loose clothing) and use provided safety gear when required.

  • Treat all participants, staff, and equipment with respect. Harassment, discrimination, or disruptive behavior will not be tolerated and may result in removal from the studio.

  • Clean your workspace and return tools to their designated places after use.

b. Class and Workshop Policies

  • Registration: Pre-registration and payment are required for all classes and workshops. Spots are reserved on a first-come, first-served basis.

  • Cancellations and Refunds:

    • Cancellations made more than 7 days before the class start date are eligible for a full refund, minus a 5% processing fee.

    • Cancellations made less than 7 days before the class start date are not refundable but may be transferred to another class of equal value, subject to availability.

  • We reserve the right to cancel classes due to insufficient enrollment or unforeseen circumstances. In such cases, you will receive a full refund or the option to reschedule.

  • Attendance: Arrive on time. Late arrivals may not be accommodated, and missed sessions are not refundable.

  • Firing and Glazing: Completed pieces are subject to our firing schedule. We are not responsible for damage to pieces due to improper construction or unforeseen kiln issues.

c. Studio Membership and Open Studio Access

  • Membership: Studio memberships are available for experienced potters, subject to approval. Members must demonstrate proficiency in pottery techniques and adhere to studio policies.

  • Materials and Storage: Members must use studio-provided clay and glazes unless otherwise approved. Personal items and works-in-progress must be stored in designated areas and removed within 30 days of completion.

  • Equipment Use: Members are responsible for any damage to studio equipment caused by misuse or negligence.

d. Personal Belongings

  • We are not responsible for lost, stolen, or damaged personal belongings in the studio.

4. Purchases and Payments

​a. Product Purchases

  • All sales of ceramic products are final, except in cases of damage during shipping or manufacturing defects.

  • Shipping costs and estimated delivery times are provided at checkout. We are not responsible for delays caused by third-party carriers.

b. Payment

  • Payments are processed securely through third-party providers. You agree to provide accurate payment information and authorize charges for your purchases or class fees.

  • All prices are in USD and exclude applicable taxes unless otherwise stated.

5. Intellectual Property

All content on our website, including images, designs, logos, and class materials, is owned by Hatch Clayworks, LLC or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission, except for personal, non-commercial use.

6. User Content

  • If you submit designs, photos, or other content to us (e.g., for custom orders or social media features), you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for promotional or operational purposes. You represent that you own or have the right to submit such content.

7. Limitation of Liability

To the fullest extent permitted by law:

  • Our Services are provided "as is" without warranties of any kind, express or implied.

  • We are not liable for any indirect, incidental, or consequential damages arising from your use of our Services, including but not limited to loss of data, profits, or artwork.

  • Our total liability for any claim related to our Services will not exceed the amount you paid us for the specific Service giving rise to the claim.

8. Indemnification

  • You agree to indemnify and hold harmless Hatch Clayworks, LLC, its affiliates, and employees from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, misuse of our Services, or infringement of third-party rights.

9. Termination

  • We may terminate or suspend your access to our Services at our discretion, without notice, for conduct that violates these Terms or is harmful to other users or our business.

10. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved through binding arbitration in Ashland, Wisconsin, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Changes to These Terms

  • We may update these Terms at any time by posting the revised version on our website. The updated Terms will take effect upon posting, and your continued use of our Services constitutes acceptance of the changes.
